TERMS AND CONDITIONS OF USE (T&C)

1. Purpose

These Terms and Conditions of Use ("T&C") govern access to and use of the RentEqui platform, operated by AA Digital Services.

By accessing or using the platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms without reservation.

2. About RentEqui

RentEqui is a digital platform designed to connect:

• Owners of professional equipment, machinery, vehicles, and tools; and
• Companies or individuals seeking to rent such equipment.

The platform solely facilitates communication between users.

RentEqui is neither the owner, lessor, nor lessee of any equipment listed on the platform.

3. Scope of Application

These Terms apply to all users of the platform, including:

• Visitors;
• Companies;
• Equipment owners;
• Service providers;
• Self-employed professionals (Auto-Entrepreneurs);
• Registered users.

4. Account Registration

Access to certain features requires the creation of a user account.

Users agree to provide accurate, complete, and up-to-date information when registering.

Users are responsible for maintaining the confidentiality of their login credentials and password.

Any activity carried out through a user's account shall be deemed to have been performed under that user's responsibility.

5. Verification of Professional Accounts

RentEqui may request supporting documents to verify a user's identity or business activity, including but not limited to:

• Commercial Register (RC);
• Tax Identification Number (NIF);
• Auto-Entrepreneur Card;
• Business Activity Certificate;
• Any other document deemed necessary.

RentEqui reserves the right to refuse, suspend, or delete any account containing inaccurate, incomplete, or fraudulent information.

6. Listing of Equipment

Users are solely responsible for the listings they publish.

Each listing must contain accurate information, including:

• Equipment description;
• Technical specifications;
• Operational condition;
• Availability;
• Location;
• Representative photographs.

Misleading, false, or unlawful listings may be removed without prior notice.

7. Use of the Platform

Users agree to use RentEqui in compliance with applicable laws and shall not:

• Publish false or misleading information;
• Impersonate another person or entity;
• Publish illegal, defamatory, or offensive content;
• Disrupt the operation of the platform;
• Attempt unauthorized access to computer systems.

8. Nature of the Service

RentEqui is exclusively a marketplace connecting equipment owners and renters.

The platform does not:

• Participate in negotiations;
• Set rental prices;
• Draft rental agreements;
• Process payments between users;
• Guarantee the quality or condition of equipment;
• Provide insurance services.

Users enter into agreements directly with one another.

9. Payments Between Users

All payments relating to equipment rentals are made directly between the equipment owner and the renter.

RentEqui never intervenes in:

• Payments;
• Invoicing;
• Collection of funds;
• Refunds;
• Security deposits.

Any financial dispute is solely the responsibility of the parties involved.

10. User Responsibilities

Each user is solely responsible for:

• The information they publish;
• Their listings;
• Rental agreements concluded;
• Payments made or received;
• Delivery and return of rented equipment;
• The condition of rented equipment.

11. Limitation of Liability

RentEqui shall not be held liable for:

• The quality, condition, or performance of equipment;
• Delivery delays;
• Property damage or personal injury;
• Financial losses;
• Contractual disputes between users;
• Unpaid amounts;
• Reservation cancellations;
• Information published by users.

RentEqui's liability is strictly limited to its role as an online platform connecting equipment owners and renters.

12. Account Suspension or Termination

RentEqui may suspend or permanently terminate any account without prior notice in cases including, but not limited to:

• Fraud;
• Submission of false documents;
• Violation of these Terms;
• Abusive behavior;
• Publication of prohibited content;
• Any activity that compromises the security, integrity, or reputation of the platform.

13. Intellectual Property

All elements of the platform, including but not limited to:

• The RentEqui logo;
• The RentEqui name;
• Text;
• Images;
• Databases;
• Software;

are protected by applicable intellectual property laws.

Any reproduction, modification, distribution, or use without prior written authorization is strictly prohibited.

14. Personal Data Protection

The processing of personal data is governed by the RentEqui Privacy Policy, available on the platform.

15. Amendments to the Terms

RentEqui reserves the right to modify these Terms and Conditions of Use at any time.

Any revised Terms shall become effective immediately upon publication on the platform.

16. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the People's Democratic Republic of Algeria.

In the event of a dispute, the parties agree to seek an amicable settlement before initiating legal proceedings.

If no amicable resolution is reached, the competent courts of Algeria shall have exclusive jurisdiction.
